Unfair Dismissal - Gross Misconduct

A client sought our assistance after an employee brought an Employment Tribunal claim against them.

Situation

The employee was dismissed for gross misconduct following repeated clocking-in offences and brought a claim for unfair dismissal.

Solution

We helped our client all the way through the claim. We provided a robust defence to the claim from the first day, highlighting the company’s clear policies, consistent enforcement of clocking guidelines and the fair disciplinary process which was followed when dismissing the employee.

Outcome

The Employment Tribunal ultimately ruled in our client’s favour, dismissing the unfair dismissal claim. We have gone on to achieve many successful results on behalf of our employer clients.
